As i stated in my last post the TM/TP9400 series are phase 2 radios, the same as a APX series.
As for who gets access to band plan 9 who knows. I'd only be speculating.

Evening all, The Taits that NSW ambulance have are TM and TP9400's which are phase 2 radios. You'll find the control channel will run on the phase 1 bandplan (04-xxxx) which is the current band plan and the phase 2 radios will use band plan 6 for voice, certain users will have access to others like ...

They're the actual voice channels the 40mhz stuff is point to point.
The NSWEN (FMR. Transgrid) network is pretty quiet down my way, you hear a slow Morse ident every now and then but very little activity.
