Re: Civil Air Patrol Copyright Infringement
Dear Mr. Blanton:
1. Our Chief of Communications, Malcolm C. Kyser Jr., previously send your
support@radioreference.com an email dated 27 Mar 2013 requesting your company to remove from one
of your forum members post a current Communications Plan file from a Civil Air Patrol wing. To date,
you have failed to comply with our request.
2. On behalf of Civil Air Patrol you are hereby directed you to remove the abovementioned
Communications Plan file and to further cease and desist use of the Civil Air Patrol name, insignia,
copyrights, emblems, badges, marks and words adopted by the Civil Air Patrol. This specifically
includes, and is not limited to, any use of such material or unauthorized reference thereto on your website
at http://forums.radioreference.com/milita ... ir-patrol-
6.html#post1939104. Civil Air Patrol has not given you previous written consent for the usage or
publication of said document.
3. As set forth in 36 USC §40306, Civil Air Patrol has the "exclusive right to name, insignia, copyrights,
emblems, badges, marks, and words" the corporation adopts. Therefore, we reiterate that you are hereby
directed to cease and desist in your use, publication, dissemination, distribution or reference to said
document or file and refrain from the use or reference to the CAP name, logos, insignia, emblems,
badges, marks and words or the use of any and all CAP e-mail lists for any commercial purposes.
4. Please note that failure to comply with this letter may result in CAP filing legal action seeking
injunctive relief, damages, attorney’s fees and court costs.
